Kasunduan ng PhilHealth, PH Red Cross legal

Inihayag ng Philippine Red Cross (PRC) na legal at wala silang nilabag na batas kaugnay sa memorandum of agreement (MOA) sa pagitan nila at ng Philippine Health Insurance Corp. (PhilHealth).

“On behalf of the Board of Governors of the Philippine Red Cross (“PRC”), and our Chairman Sen. Richard J. Gordon, we would like to say: (i) all transactions of the PhilHealth and PRC are legal and covered by the Republic Act No. 11469,” pahayag ng PRC sa isang statement.

Ginawa ng PRC ang pahayag ilang araw matapos hilingin ni Senador Leila de Lima na imbestigahan ang diumano’y ‘conflict of interest’ sa pagpasok ni Gordon at ng korporasyon sa kasunduan sa PhilHealth para sa COVID-19 test.

Giit ng PRC, walang katotohanan ang akusasyon ni De Lima.

“There is no conflict of interest in Sen. Gordon’s situation, and (iii) the disinformation being spread about the Philippine Red Cross and Chairman Gordon are totally baseless and merely meant to besmirch our reputation,” sabi ng PRC.

Lahat umano ng transaksiyon sa pagitan ng PRC at ng PhilHealth ay legal.

“All the transactions between the PRC and PhilHealth are legal and needed by the country,” giit ng PRC kung saan President at CEO si Gordon.

“It is ludicrous and a downright shame that Sen. De Lima is hitting Chairman Gordon and the PRC after they have done so much for the country. With all the time she has in incarceration, she should have first studied the law.

“She would have then discovered that the transactions in the Memorandum of Agreement dated 05 May 2020 between the PRC and PhilHealth is exempted from Republic Act No. 9184, of the Government Procurement Reform Act,” dagdag pa nito.

Sa ilalim umano ng Republic Act No. 11469 o ng Bayanihan to Heal As One Act, pinapayagan ang gobyerno na mag-undertake ng pagbili ng good, supplies at iba pa, kasama na ang test kits.

Nakasaad din sa batas na dapat unahin ng DOH ang paglalaan ng alokasyon at distribusyon ng mga good at iba pang supplies at pampubliko at pribadong laboratory na may kapasidad na mag-test ng suspected COVID-19 patient.

Nakalagay din doon na maaaring makipag-partner ang gobyerno sa PRC bilang primary humanitarian agency sa pagbibigay ng tulong sa mga tao.

“From a pragmatic point of view, and in light of pandemic, the name of the game is speed and capacity. It would be ludicrous for the PRC to have to wait to get paid before it can purchase more testing kits, which is the primary reason for the revolving fund,” ayon sa PRC.

Naunang inakusahan si Gordon at ang PRC ng pagtanggap ng advance payment mula sa PhilHealth para sa COVID-19 test.

Giit ng PRC, nangyari lang ito ng isang beses at may ‘unsettled obligation’ pa nga ang PhilHealth sa kanila ng halos kalahating bilyong piso.

“The advance payment happened only once and after that, it was already the PRC which has been advancing the tests inspite of PhilHealth’s unsettled obligations to PRC, which is now more than PhP 500 Million,” sabi ng PRC.

“Previously and currently, the PRC would order the test kits from China and we need to pay before we order, which means the PRC needs funds, and then had to either charter a plane or request for the Philippine Air Force to provide a plane to pick up the same,” dagdag pa nito.

Sabi pa ng PRC, wala silang nakikitang conflict of interest dahil si Gordon ay volunteer na sa PRC sapul pa noong 1967.

“Chairman Gordon has been a volunteer in the PRC since 1967. He has grown the PRC to unimaginable heights but he is not paid and has never received any benefits nor dividends from his because the latter is a non-stock, non-profit corporation. How could there be a conflict?” tanong nito.

“There is no conflict of interest in Chairman Gordon being the chairman of the PRC, and his having investigated PhilHealth,” dagdag pa nito.
